Terms of service

For shops subscribing to CocoTill. Members want the card terms instead.

These are the terms on which a business uses CocoTill and Coco Regulars. Plain English, and short, because a long contract nobody reads protects nobody.

Who you are contracting with

The service is provided by AadhiPixels Ltd, company no. 16230492, registered in England & Wales, trading as The Third Coconut. Contact: hello@thethirdcoconut.com.

These terms are for businesses. They are not a consumer contract, and the consumer cancellation rights that would apply to one do not apply here.

Your account

You are responsible for what happens under your account, including anything your staff do with the codes and logins you issue them. Keep them to people who should have them.

You must have the right to hold the customer data you put into the service, and to contact the people in it. We provide the tools; you decide who is on your list and what you send them.

Plans, prices and billing

  • Plans are Free, Growth and Pro. Current prices and limits are on the pricing page and in CocoTill; they are the same numbers, from the same source.
  • Paid plans are billed monthly or yearly in advance by Stripe, and renew automatically until cancelled.
  • Prices are in pounds sterling. We are not currently VAT-registered, so no VAT is charged; if that changes we will tell you before it applies to you.
  • We may change prices with at least 30 days' notice by email. If a change does not suit you, cancel before it takes effect and you will not be charged the new price.

Cancelling, and refunds

Cancel any time from the billing page. There is no minimum term and no cancellation fee. Cancellation takes effect at the end of the period you have already paid for, and you keep your plan's features until then.

We do not refund part-months as a matter of course, because you keep the service to the end of the period you paid for. If something on our side went materially wrong — the service was unavailable for an extended period, or you were charged for a plan you did not order — email us and we will put it right, including a refund where that is the fair answer.

Printed QR packs are physical goods made to your order. Once a pack has gone to print it cannot be refunded, unless it arrives damaged or wrong, in which case we replace it.

Your data, and getting it out

Your customer list is yours. You can export it at any time from CocoTill, in a format you can open and use elsewhere, and you do not need to ask us.

If you close your account we keep your data for 30 days in case you change your mind, then delete it. Billing records are kept for six years because HMRC requires it.

For loyalty member data we act as your processor. The processing terms are in the privacy notice, which forms part of these terms.

What we promise, and what we do not

We will provide the service with reasonable skill and care, and keep it available as consistently as we reasonably can. We do not promise it will never be unavailable — we are a small company running on shared infrastructure, and pretending otherwise would be a lie.

Modules marked as not yet shipped are not part of what you are buying until they are. The pricing page shows which is which, and it is generated from the same readiness flags the app uses, so it cannot overstate them.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you in any 12-month period is limited to the fees you paid us in that period, and we are not liable for lost profits or lost business.

Acceptable use

  • Do not use the service to send unsolicited marketing to people who have not agreed to hear from you.
  • Do not upload data you have no right to hold, or use the service to break the law.
  • Do not attempt to access another business's data, or to circumvent plan limits.
  • We may suspend an account that is doing any of these, and will tell you why.

Ending it

You can leave at any time. We can end an account with 30 days' notice, or immediately if it is being used in breach of the acceptable-use section above. If we end your account without cause, we refund the unused part of anything you have paid in advance.

The legal bits

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
